📘 Security Deposit (SD) vs Performance Guarantee (PG)

🔹 1. Object / उद्देश्य

English:

• Security Deposit (SD):
  It is taken as a security to ensure due fulfillment of the contract conditions.
• Performance Guarantee (PG):
  It is taken to ensure successful and satisfactory performance of the work by the contractor. It is introduced to reduce the risk of contract failure.

Hindi:

• सिक्योरिटी डिपॉज़िट (SD):
  यह अनुबंध की शर्तों के सही पालन की सुरक्षा के रूप में लिया जाता है।
• परफॉर्मेंस गारंटी (PG):
  यह ठेकेदार द्वारा कार्य को सफलतापूर्वक पूरा करने की गारंटी के रूप में लिया जाता है। इसका उद्देश्य कार्य में विफलता के जोखिम को कम करना है।

🔹 2. Due Date / जमा करने की समय सीमा

English:

• Security Deposit (SD):
  EMD/Bid Security of the successful bidder is adjusted towards SD. The remaining amount is recovered at 6% from each running bill until full SD is recovered.
• Performance Guarantee (PG):
  It is submitted by the successful bidder after issue of LOA (Letter of Acceptance) within 60 days:
  • Within 21 days from LOA – No interest
  • Between 22 to 60 days – 12% penal interest per annum

Hindi:

• सिक्योरिटी डिपॉज़िट (SD):
  सफल बोलीदाता की EMD/बिड सिक्योरिटी को SD में समायोजित किया जाता है। शेष राशि प्रत्येक रनिंग बिल से 6% की दर से काटी जाती है जब तक पूरी SD जमा न हो जाए।
• परफॉर्मेंस गारंटी (PG):
  LOA जारी होने के बाद 60 दिनों के भीतर जमा करनी होती है:
  • LOA के 21 दिनों के अंदर – कोई ब्याज नहीं
  • 22 से 60 दिनों के बीच – 12% वार्षिक दंडात्मक ब्याज

🔹 3. Balance / शेष राशि

English:

• Security Deposit (SD):
  It is recovered only from running bills at 6% deduction. No other mode of collection is allowed.
• Performance Guarantee (PG):
  Can be submitted in forms like Cash, Irrevocable Bank Guarantee, Government Securities, Demand Drafts of nationalized banks, NSCs, etc.

Hindi:

• सिक्योरिटी डिपॉज़िट (SD):
  केवल रनिंग बिल से 6% की कटौती द्वारा वसूली की जाती है। अन्य कोई तरीका मान्य नहीं है।
• परफॉर्मेंस गारंटी (PG):
  नकद, अटल बैंक गारंटी, सरकारी प्रतिभूति, राष्ट्रीयकृत बैंक का डिमांड ड्राफ्ट, NSC आदि रूपों में जमा की जा सकती है।

🔹 4. If Fails / यदि जमा न हो

English:

• Security Deposit (SD):
  There is no issue of non-submission because it is automatically recovered from running bills.
• Performance Guarantee (PG):
  If not submitted within 60 days from LOA:
  • Contract may be terminated
  • EMD may be forfeited
  • Contractor may be debarred from future tenders

Hindi:

• सिक्योरिटी डिपॉज़िट (SD):
  जमा न करने की स्थिति नहीं होती क्योंकि यह बिल से स्वतः काट ली जाती है।
• परफॉर्मेंस गारंटी (PG):
  60 दिनों में जमा न करने पर:
  • अनुबंध समाप्त किया जा सकता है
  • EMD जब्त की जा सकती है
  • ठेकेदार को भविष्य की निविदाओं से प्रतिबंधित किया जा सकता है

🔹 5. Release / वापसी

English:

• Security Deposit (SD):
  Released after:
  • Physical completion of work
  • Maintenance period completion
  • Passing of final bill
  • Submission of No Claim Certificate
  • Submission of No Dues Certificate
• Performance Guarantee (PG):
  Released immediately after physical completion of work.

Hindi:

• सिक्योरिटी डिपॉज़िट (SD):
  वापसी की शर्तें:
  • कार्य की भौतिक पूर्णता
  • मेंटेनेंस अवधि पूर्ण होना
  • अंतिम बिल पास होना
